Introduction

Schools act as Data Controllers for the Personal Data they collect. The Information Commissioners Office (ICO), in their Data Sharing Code of Practice, outline a framework and guidance for organisations to ensure they have the appropriate protocols and agreements in place in relation to data protection.

With the change to the GDPR all organisations must now have a data exchange agreement if it shares personal data.

The Somerset Data Sharing Agreement (see link in the next box) is the agreement that has been constructed to enable schools to share data with the LA authority and other connected agencies.

This year the Data Exchange Agreement has been re-written to aid clarity and to emphasize the legal and statutory duties of both the Educational provider and the Local Authority.

 

All Educational Providers should check the form and then agree to is by filling in the online acceptance form. 

The Local Authority agreement is given by providing this form.

If schools share personal data with other agencies then they will also need to make sure that this data is shared carefully.  In most cases this is in the original contract but forms are also provided if the schools wish to make their own agreements.
